SECTION 1 — ELIGIBILITY AND USE

By using our Services you confirm that:

• You are at least 18 years of age
• Any information you provide is accurate and current
• You will use the Services for lawful purposes only

You are responsible for maintaining the confidentiality of any account credentials and for all activity conducted under your account.

EuroFloat reserves the right to suspend or terminate access if these Terms are breached.


SECTION 2 — PRODUCTS AND INFORMATION

EuroFloat sells horse floats and related accessories.

We attempt to ensure that product descriptions, specifications, features, colours and images are accurate. However:

• Colours may vary depending on your screen or device
• Images may include optional extras not included in the base price
• Specifications and features may change without notice

EuroFloat reserves the right to modify or discontinue products at any time.


SECTION 3 — ORDERS AND PURCHASES

Placing an order constitutes an offer to purchase.

Orders are only confirmed once EuroFloat:

  1. Accepts the order

  2. Receives any required payment or deposit

EuroFloat reserves the right to accept or decline orders at its discretion.

Deposits placed on floats or custom orders are handled in accordance with our Refund Policy.


SECTION 4 — PRICING AND PAYMENT

All prices are in Australian Dollars (AUD) unless otherwise stated.

Prices:

• May change without notice
• May exclude delivery, registration, or optional upgrades
• May differ from dealership or showroom pricing

Customers agree that:

• Payment information provided is accurate
• They are authorised to use the payment method
• All applicable charges will be paid


SECTION 5 — SHIPPING, COLLECTION AND DELIVERY

Delivery times are estimates only.

EuroFloat is not responsible for delays caused by:

• Freight companies
• Weather conditions
• Supply chain disruptions
• Events outside our control

Risk of loss or damage passes to the customer once the product is collected or handed to a transport provider.

Customers must inspect goods upon delivery and report any issues promptly.


SECTION 6 — RETURNS AND REFUNDS

Returns and refunds are governed by our Refund Policy.

Under Australian Consumer Law, customers are entitled to remedies where products:

• Are faulty
• Are not as described
• Are not fit for purpose

EuroFloat may request photographs or other evidence before assessing claims.


SECTION 7 — INTELLECTUAL PROPERTY

All website content including:

• Logos
• Branding
• Images
• Product descriptions
• Videos
• Website design

are the intellectual property of EuroFloat or its licensors.

These materials may not be reproduced or distributed without written permission.


SECTION 8 — THIRD-PARTY SERVICES

The website may contain links or integrations with third-party services.

EuroFloat is not responsible for the content, policies, or practices of third-party websites.

Use of these services is at your own risk.


SECTION 9 — SHOPIFY PLATFORM

EuroFloat’s website is powered by Shopify.

However, all purchases are conducted directly with EuroFloat.

Shopify is not responsible for product claims, warranties, or disputes relating to purchases made through the EuroFloat website.


SECTION 10 — PRIVACY

Personal information collected through the Services is governed by our Privacy Policy.

This policy outlines how we collect, use and protect personal information.


SECTION 11 — CUSTOMER FEEDBACK

If you submit reviews, feedback or suggestions to EuroFloat, you grant us permission to:

You confirm that submitted content does not violate the rights of others.

Occasionally the website may contain typographical errors or inaccuracies relating to:

EuroFloat may terminate access for violations.


SECTION 14 — HORSE FLOAT USE AND TOWING RESPONSIBILITY

Horse floats must be used in accordance with applicable road laws and towing regulations.

The customer is responsible for ensuring:

• Their towing vehicle is rated to tow the float
• The float is correctly connected and secured
• The load is within legal limits
• The driver complies with all road regulations

EuroFloat is not liable for damage or injury resulting from incorrect towing, overloading or misuse.


SECTION 15 — HORSE TRANSPORT AND ANIMAL LIABILITY

EuroFloat designs floats for transporting horses and livestock, however animal behaviour is unpredictable.

The customer acknowledges that:

• Horses may move, panic, kick or behave unpredictably
• Safe handling and loading of animals is the responsibility of the customer
• Animals must be properly restrained and suitable for transport

EuroFloat is not responsible for injury, illness, stress, behavioural incidents or death involving animals transported in the float, except where required under Australian Consumer Law.


SECTION 16 — VEHICLE TOWING AND LOAD RESPONSIBILITY

Customers must ensure their towing vehicle and driving practices comply with all relevant laws.

Customers are responsible for:

• Confirming vehicle towing capacity
• Ensuring the float is correctly hitched
• Ensuring the load is secure and within legal limits
• Complying with road and transport regulations

EuroFloat is not liable for accidents caused by:

• Overloading
• Improper towing
• Incompatible vehicles
• Failure to follow towing laws.


SECTION 17 — CUSTOM ORDERS AND BUILD VARIATIONS

Certain EuroFloat products may be manufactured as custom builds.

By placing a custom order the customer acknowledges that:

• Specifications and inclusions are confirmed when the order is placed
• Minor variations in materials, design or finishes may occur
• Production timelines may vary due to supply or manufacturing factors

Unless otherwise agreed in writing, custom orders cannot be cancelled once production begins.

Deposits are handled in accordance with the EuroFloat Refund Policy.


SECTION 18 — DISCLAIMER OF WARRANTIES

Except as required under Australian Consumer Law, the Services and products are provided “as is” and “as available.”

EuroFloat does not guarantee:

• Continuous website availability
• Error-free operation
• That all information is completely free from inaccuracies.


SECTION 19 — LIMITATION OF LIABILITY

To the maximum extent permitted by law, EuroFloat is not liable for:

• Indirect or consequential losses
• Loss of profit or business
• Loss of data or opportunities

Nothing in these Terms excludes rights under Australian Consumer Law.


SECTION 20 — INDEMNIFICATION

You agree to indemnify EuroFloat and its employees against claims arising from:

• Your misuse of the Services
• Breach of these Terms
• Violation of laws or third-party rights.


SECTION 21 — TERMINATION

EuroFloat may suspend or terminate access to the Services if these Terms are breached.

Termination does not affect obligations incurred before termination.


SECTION 22 — GOVERNING LAW

These Terms are governed by the laws of Queensland, Australia.

Any disputes will be handled in the courts of Queensland.


SECTION 23 — CHANGES TO TERMS

EuroFloat may update these Terms at any time.

Updated Terms will be posted on this page.

Continued use of the Services constitutes acceptance of any changes.
